6. Purchases, Pricing and Payment
a. Orders. You may purchase digital products, register for virtual workshops or engage our consulting services through the Site. When you place an order, you agree to provide accurate billing information and authorize us (and our third‑party payment processors) to charge your payment method for the total amount, including any applicable taxes and fees. b. Payment Processing and PCI DSS. Payments are processed by third‑party providers compliant with the Payment Card Industry Data Security Standard. We do not store your full credit card information on our servers.
7. Refunds, Withdrawal and Cooling‑Off Rights
a. United States and Pennsylvania. Unless stated otherwise, purchases of digital products and services are non‑refundable once access has been provided, except where required by law. b. European Union Consumers. If you are a consumer residing in the European Union, you have a 14‑day withdrawal right for distance‑selling contracts. For digital content (e‑books, downloads), you acknowledge that the right to withdraw is lost once the download or streaming has begun and that you consent to immediate performance. For virtual workshops or consulting services scheduled to occur within the 14‑day period, you may withdraw up to the start of the session; if you cancel after work has begun, you agree to pay for services performed until cancellation. We will not impose unnecessary hurdles to cancellation, in accordance with the FTC’s “Click‑to‑Cancel” rules.
8. Digital Content Quality and Warranty (EU Only)
For consumers in the EU, our digital products and services must conform to the contract. If the digital content is defective or does not match its description, you may request that we bring the content into conformity, offer a proportionate price reduction or terminate the contract in accordance with the Digital Content Directive. This statutory warranty lasts for two years from delivery. Nothing in these Terms limits your statutory rights under European consumer law.
9. Limitation of Liability
To the fullest extent permitted by law, E.fi and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or Services. Our total liability for any claim relating to the Services shall not exceed the greater of (i) the amount you paid for the Services in the six months preceding the claim (excluding the purchase price for digital products), or (ii) $100. This limitation does not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded or limited by law. In jurisdictions that do not allow limitations of liability, this limitation may not apply.
10. Disclaimer of Warranties
The Site and all Services are provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted or error‑free. We make no representations regarding any results that may be obtained from using the Services. We expressly disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non‑infringement, to the maximum extent permitted by law. Nothing in this disclaimer affects warranties that cannot be excluded by law, including statutory rights under EU consumer law.
11. Indemnification
You agree to indemnify and hold harmless E.fi and its affiliates, officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms or your misuse of the Site or Services. 13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict of law principles, except that nothing deprives EU consumers of the protection afforded by mandatory provisions of the law of their country of residence. Any dispute arising from these Terms shall first be addressed informally by contacting us at info@e‑fi.works and giving us a reasonable opportunity to resolve it. If unresolved, and unless prohibited by applicable law, disputes will be submitted to binding mediation in Lehigh County, Pennsylvania, or online via an agreed service. Consumers residing in the EU may bring proceedings in the courts of the EU member state where they live, and either party may use the European Commission’s Online Dispute Resolution platform.

Our postal address is PO Box 93, Durham, PA 18039, USA. For privacy queries, contact us at privacy@e‑fi.works. If you are located in the European Union or United Kingdom, we may designate an EU/UK representative; details will be provided on request.
2. What Information We Collect
We collect information that you provide directly and information collected automatically when you use the Site.
Information you provide:
Contact information – such as your name, email address, mailing address and telephone number when you purchase products, register for a workshop or contact us.
Payment information – such as billing address and card details. Payments are processed by third‑party payment processors; we do not retain full card numbers.
Account information – usernames, passwords and preferences if you create an account.
Content you submit – such as comments, feedback or materials uploaded to workshops.
Communications – records of your correspondence with us and any information you provide when you respond to surveys or marketing offers.
Information collected automatically:
Usage and device data – when you access the Site, our servers automatically log your IP address, browser type, operating system, referring URLs and pages visited. This data helps us administer and improve the Site.
Cookies and similar technologies – we use cookies, pixels and local storage to recognize your browser, remember your preferences and measure the effectiveness of campaigns. Cookies are small text files stored on your device. Some cookies are essential (needed for the site to function) while others (analytics or marketing) are non‑essential and require consent. Our cookie banner allows you to manage your preferences. You may also configure your browser to reject cookies, though this may affect functionality.
Information from third parties:
Payment processors – we receive confirmation of payment and limited transaction details from our payment providers.
Analytics and marketing providers – we use analytics services to understand how users interact with our Site. These providers may collect information such as your IP address, device identifiers and interactions with the Site.
3. Legal Bases for Processing (GDPR)
We rely on the following legal bases to process personal data:
Performance of a contract – to provide the products or services you request, process transactions and deliver digital content.
Legitimate interests – to operate, maintain and improve our Site; to communicate with you about your account or respond to enquiries; to prevent fraud and ensure security; and, where permitted, to send marketing communications relevant to you. We balance our interests against your rights and obtain consent where required.
Consent – for sending marketing emails to EU residents, deploying non‑essential cookies and processing any special categories of data (we do not intentionally collect such data). You can withdraw your consent at any time.
Compliance with a legal obligation – to comply with tax, accounting and data‑breach notification obligations and to respond to lawful requests by public authorities.
4. How We Use Your Information
We use personal information for the following purposes:
To provide and administer Services – including delivering digital products, registering you for workshops, scheduling consulting sessions and providing customer support.
To process payments and prevent fraud – we use your information and third‑party services to complete transactions and detect fraudulent activity.
To communicate with you – we send administrative messages (transaction receipts, service announcements, security notices) and respond to your enquiries. With your consent or where allowed under CAN‑SPAM, we may send marketing emails about new products, services or promotions. You can opt out at any time via the unsubscribe link or by emailing privacy@e‑fi.works.
To personalize and improve our Site – we analyze usage patterns to understand user preferences and enhance functionality, content and security.
To comply with legal obligations – we may use your information to comply with applicable laws, court orders or enforce our agreements.
5. Sharing and Disclosure
We do not sell your personal information. We may share data with:
Service providers – such as payment processors, hosting providers, email service providers, analytics and marketing vendors. These providers act under confidentiality agreements and only process data on our instructions.
Affiliates and subsidiaries – to the extent necessary to operate our business in compliance with this policy.
Legal and law enforcement – we may disclose information if required by law or necessary to protect the rights, property or safety of E.fi, our users or others.
Business transfers – in connection with a merger, acquisition or sale of assets, provided the acquiring entity assumes the rights and obligations under this policy.
Other users – if you participate in forums, workshops or public portions of the Site, some information (such as your name and comments) may be visible to other participants. Please do not post sensitive information.
6. International Data Transfers
Because we are based in the United States, personal data may be transferred to and processed in countries outside of your residence, including countries that may not have equivalent data‑protection laws. When we transfer personal data of individuals in the EU, UK or Switzerland outside of those regions, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses or an adequacy decision. You may request a copy of these safeguards by contacting privacy@e‑fi.works.
7. Data Retention
We retain personal data only as long as necessary to fulfil the purposes described above and to comply with legal obligations. Typically, we retain contact and account information for as long as you maintain an account or until you request deletion, and thereafter as required for legal and accounting purposes. Transaction records are retained for at least seven years. We periodically review data we hold and securely delete or anonymize it when it is no longer needed.
8. Security
We employ technical and organizational measures to protect personal information, including encryption in transit (HTTPS), secure server hosting, access controls and regular security assessments. However, no method of transmission or storage is completely secure; you provide data at your own risk. If we detect a security breach that affects your personal information, we will notify you and relevant authorities as required by the BPINA and GDPR.
9. Your Rights
Depending on your jurisdiction, you may have the following rights:
Right to access – obtain confirmation as to whether we process your personal data and receive a copy of that data.

Right to erasure (“right to be forgotten”) – request deletion of your personal data where the legal basis for processing no longer applies.
Right to restrict processing – ask us to restrict processing of your data under certain circumstances.
Right to data portability – obtain a copy of data you provided to us in a structured, commonly used, machine‑readable format and have it transmitted to another controller.
Right to object – object to processing based on legitimate interests or direct marketing. When we rely on legitimate interest, we will stop processing unless we have compelling legitimate grounds.
Right to withdraw consent – you may withdraw consent at any time without affecting prior processing.
Right to lodge a complaint – if you are an EU resident, you may lodge a complaint with your local data‑protection authority. U.S. residents may lodge complaints with the Federal Trade Commission or state regulators.
To exercise these rights, contact privacy@e‑fi.works. We may verify your identity before responding and will reply within the timeframe required by law.
10. Children’s Privacy
The Site is not intended for children under 13. We do not knowingly collect personal information from children. If you are a parent or guardian and believe a child has provided us with personal information, please contact us and we will delete it. If we learn that we have collected information from a child under 13 without verifiable parental consent, we will take steps to remove that information in compliance with COPPA.
11. Marketing Communications and CAN‑SPAM Compliance
We may send marketing emails about products, services or events that may interest you. In the U.S., we comply with the CAN‑SPAM Act. All marketing emails will (i) clearly identify themselves as advertisements, (ii) include our physical postal address and (iii) provide a working unsubscribe link. We honor opt‑out requests promptly and will not send further marketing messages if you opt out. EU residents will receive marketing emails only with prior consent.
12. Third‑Party Links
Our Site may contain links to websites or services operated by third parties. We do not control and are not responsible for the privacy practices of these sites. We encourage you to read the privacy policies of any third‑party site you visit.
13. Changes to This Policy

When we make material changes, we will post a prominent notice on our Site or send you an email. The revised policy will become effective on the date indicated in the notice. Your continued use of the Site after the effective date constitutes acceptance of the updated policy.
